Athletic Liability Waiver

 1. Introduction: This Waiver of Liability, Assumption of Risk, and Indemnity Agreement is entered into by and between [Participant's listed] and Alabama Training and Athletics Complex LLC with respect to the Participant's involvement in athletic activities organized, sponsored, or conducted by the Organization.

2. Acknowledgment of Risk: I, the undersigned Participant, acknowledge that participating in athletic activities involves inherent risks, including but not limited to the risk of injury, illness, or death. These risks may result from various factors, including, but not limited to, physical exertion, equipment failure, and the actions or inactions of other participants.

3. Assumption of Risk: I understand and agree that my participation in any athletic activity is voluntary. I hereby assume all risks associated with my participation, including those caused by the negligence of the Organization or its employees, agents, or representatives.

4. Waiver of Liability In consideration of being permitted to participate in athletic activities, I hereby release, waive, and discharge the Organization, its officers, directors, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me, whether caused by the negligence of the Organization or otherwise while participating in such activities or while on the premises where the activities are conducted.

5. Indemnity Agreement I agree to indemnify, defend, and hold harmless the Organization from any and all claims, demands, actions, causes of action, damages, costs, and expenses, including attorney’s fees, arising out of or related to my participation in athletic activities, whether caused by the negligence of the Organization or otherwise.

6. Medical Authorization I hereby grant permission to the Organization to secure medical treatment for me in the event of an emergency. I agree to be responsible for any costs incurred for such treatment.

7. Video and Photography: Release I consent to the use of photographs and/or video recordings taken of me during athletic activities for promotional or marketing purposes by the Organization, without compensation or further notice.

 8. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the state of Alabama, without regard to its conflict of law principles.

9.Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10.Entire Agreement This Agreement constitutes the entire understanding between the parties with respect to the subject matter herein and supersedes all prior or contemporaneous agreements, whether written or oral.

Building Liability Waiver

 1. Introduction: This Liability Waiver is executed on the named date by named below in favor of Earl Campbell and Daniel Robinson of A.T.A.C. LLC and Alabama Training and Athletics Complex LLC at 141 Nick Fitcheard Rd, Huntsville, AL.

2. Acknowledgment of Risk: I, the undersigned Participant, acknowledge that entering, using, and/or participating in activities within the building and supportive grounds involves certain inherent risks, including but not limited to, the risk of personal injury, property damage, or other harm. These risks may arise from various factors, including but not limited to the condition of the building, maintenance activities, the actions or inactions of other occupants, and the inherent risks associated with the specific activities conducted within the building or on the premises.

3. Assumption of Risk: I understand and agree that my presence in the building is voluntary. I hereby assume all risks associated with my entry, use, and participation in activities within the building and supporting grounds, including those caused by the negligence of the Owner/Manager or other occupants.

4. Waiver of Liability: In consideration of being permitted to enter, use, and participate in activities within the building and supporting grounds, I hereby release, waive, and discharge the Owner/Manager, its officers, directors, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me while in the Building or on the premises whether caused by the negligence of the Owner/Manager or otherwise.

5. Indemnity Agreement: I agree to indemnify, defend, and hold harmless the Owner/Manager from any and all claims, demands, actions, causes of action, damages, costs, and expenses, including attorney’s fees, arising out of or related to my entry, use, and participation in activities within the building, and supporting grounds whether caused by the negligence of the Owner/Manager or otherwise.

6.Compliance with Rules: I agree to comply with all rules, regulations, and policies of the building and supporting grounds. I acknowledge that the Owner/Manager reserves the right to terminate my access to the facility for any reason, including my failure to comply with rules and policies.

Damage, Loss, or Theft Liability Waiver

1. Introduction: This Liability Waiver is executed on the mentioned date and by in favor of Earl Campbell/ Daniel Robinson of A.T.A.C LLC ("Owner/Manager") and pertains to the premises located at “ATAC” 141 Nick Fitcheard Rd NW Huntsville, AL.

 2. Acknowledgment of Risk: I, the undersigned Participant, acknowledge that bringing personal property onto the Premises involves inherent risks, including but not limited to, the risk of damage, loss, or theft of such property. These risks may arise from various factors, including but not limited to other individuals’ actions or inactions, environmental factors, and unforeseen circumstances.

3. Assumption of Risk: I understand and agree that my decision to bring personal property onto the Premises is voluntary. I hereby assume all risks associated with the damage, loss, or theft of my personal property while on the Premises, including those caused by the negligence of the Owner/Manager or other individuals.

4. Waiver of Liability: In consideration of being permitted to bring personal property onto the Premises, I hereby release, waive, and discharge the Owner/Manager, its officers, directors, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any damage, loss, or theft of my personal property while on the Premises, whether caused by the negligence of the Owner/Manager or otherwise.

6. No Insurance Provided: I acknowledge and agree that the Owner/Manager does not provide insurance coverage for my personal property. I am solely responsible for obtaining and maintaining insurance coverage for my personal property if I so desire.
