Building Liability Waiver
1. Introduction: This Liability Waiver is executed on the named date by named below in favor of Earl Campbell and Daniel Robinson of A.T.A.C. LLC and Alabama Training and Athletics Complex LLC at 141 Nick Fitcheard Rd, Huntsville, AL.
2. Acknowledgment of Risk: I, the undersigned Participant, acknowledge that entering, using, and/or participating in activities within the building and supportive grounds involves certain inherent risks, including but not limited to, the risk of personal injury, property damage, or other harm. These risks may arise from various factors, including but not limited to the condition of the building, maintenance activities, the actions or inactions of other occupants, and the inherent risks associated with the specific activities conducted within the building or on the premises.
3. Assumption of Risk: I understand and agree that my presence in the building is voluntary. I hereby assume all risks associated with my entry, use, and participation in activities within the building and supporting grounds, including those caused by the negligence of the Owner/Manager or other occupants.
4. Waiver of Liability: In consideration of being permitted to enter, use, and participate in activities within the building and supporting grounds, I hereby release, waive, and discharge the Owner/Manager, its officers, directors, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me while in the Building or on the premises whether caused by the negligence of the Owner/Manager or otherwise.
5. Indemnity Agreement: I agree to indemnify, defend, and hold harmless the Owner/Manager from any and all claims, demands, actions, causes of action, damages, costs, and expenses, including attorney’s fees, arising out of or related to my entry, use, and participation in activities within the building, and supporting grounds whether caused by the negligence of the Owner/Manager or otherwise.
6.Compliance with Rules: I agree to comply with all rules, regulations, and policies of the building and supporting grounds. I acknowledge that the Owner/Manager reserves the right to terminate my access to the facility for any reason, including my failure to comply with rules and policies.
7.Medical Authorization: I hereby grant permission to the Owner/Manager to secure medical treatment for me in the event of an emergency. I agree to be responsible for any costs incurred for such treatment.
8.Governing Law: This Waiver shall be governed by and construed in accordance with the laws of the state of Alabama without regard to its conflict of law principles.
9.Severability: If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10.Entire Agreement: This Waiver constitutes the entire understanding between the parties with respect to the subject matter herein and supersedes all prior or contemporaneous agreements, whether written or oral.
